Applicable Form of Executive Clemency: Commutation of Sentence

Eligibility: All inmates are eligible to apply. Inmates become eligible for commutation of sentence at the same time they become eligible for parole. However, the Oklahoma Pardon and Parole Board sometimes considers an inmate for a commutation earlier than his/her scheduled consideration date.

Application Process: The Oklahoma Pardon and Parole Board is charged with making clemency recommendations to the Governor for adult prisoners convicted of felonies. Eligible inmates should request that their sentence be considered for commutation at their parole hearing, and follow any instructions given by the Board.

Inmates seeking early consideration of commutation (that is, earlier than the regularly scheduled date) must convince a majority of the five-member Board to vote in favor of early consideration. Each member of the Board maintains a post office box through which inmates can contact them by letter. An inmate should write a letter requesting early consideration and send a copy to each of the five Board members. No content guidelines have been established for the letters. Inmates are encouraged, along with basic information (name, inmate number, location, etc.), to include as much information as necessary to provide Board members with a complete history of the crime(s) involved and an understanding of the circumstances that warrant early consideration and commutation. When corresponding with Board members, please place the following information on the outside of the envelope and the letter (Do not send registered mail):

If a Board member takes an interest in an inmate's letter, they can contact the administrative office and request a Pre-docket Investigation Report which is a brief, official overview of the inmate, their crime, sentence length, and activity since being incarcerated. At a subsequent meeting of the Board, the member who initiated the request discusses the case with the rest of the Board. If early consideration is approved by a majority of the Board, the case is considered at the next available meeting thereafter.
