Applicable Form of Executive Clemency: Commutation of Sentence
Eligibility: All inmates are eligible to apply.
Application Process: Inmates requesting a commutation of sentence initiate the process by submitting an application to:

The Governor's office may reject the application outright, or forward it to the Attorney General's Office for an investigation. The Attorney General will make a recommendation at the conclusion of the investigation. The Governor will make his or her decision after reviewing the investigation's findings and the Attorney General's recommendation.

All inmates who are serving a life sentence without the possibility of parole will be sent a questionaire after serving 20 years of their sentence. After this questionaire is completed an investigation will be conducted by the Hawaii Paroling Authority to examine if a commutation of sentence should be granted. This is forwarded and reviewed by the Department of Public Safety, which issues a recommendation. It is then forwarded and reviewed by the Attorney General's Office that also issues a recommendation. The investigation and recommendations are reviewed by the Governor who then makes the final decision to grant or deny a commutation of sentence.
